I. Scope of application

The following general terms and conditions apply to all contracts concluded by us regarding deliveries and other services.

II. Orders and contracts

By submitting the order in the Internet shop, the customer makes a binding offer directed at the conclusion of a purchase contract through the goods contained in the order form. By sending the order the customer recognizes these terms and conditions as for the legal relationship with the offerer.

All contracts and / or agreements concluded with our customers must be made in writing.
We always reserve the right to accept the contract.
We confirm the receipt of your order by sending a confirmation e-mail.
This acknowledgment of receipt does not constitute a binding acceptance of the order. The acceptance of the order takes place by the delivery of the goods or an explicit declaration of acceptance.

III. Prices

Our price list is not binding. Orders and agreements on deliveries and / or services shall become binding only if these are available in written form. The prices are goods prices and do not include shipping costs.

IV. Payments

The payment of the goods is by prepayment or Paypal (without Paypal account it’s possible to use credit card payment via Paypal)
The shipping of the goods takes place after your payment is received on our account.
The goods remain our property until full payment has been received.

V. Warranty and Guarantee

For the articles offered in our shop the legal warranty rights exist.

The statutory period of limitation for warranty claims by the customer is 2 years for newly manufactured items, 1 year for used items and 1/2 year for batteries, starting from receipt of the goods by the customer or his representative.

After delivery and receipt of the goods, you have the right to rectify defective goods at first instance (supplementary performance) and, should this not be possible to get replaced by new product.
If you have legal requirements, you have the legal rights to reduction or rescission as well as to damages.
Damage to wear is not subject to defects.

A claim for warranties shall be forfeited if:

The goods are not used for the stated purpose.
The goods are operated outside the factory set parameters (tuning).
The goods are improperly and / or incorrectly connected to other devices electrically and / or mechanically.
The housing of the goods is opened and / or the seal on the housing of the goods is damaged.
The product exhibits overheating damage due to overloading and / or incorrect installation.
VI. Manufacture of electric bicycles, e-bikes and pedelecs

The customer bears full legal responsibility for the electric bicycles he produces (pedelecs, e-bikes).
Furthermore, the customer ensures that the respective legal provisions regarding the production and application, especially in the public transport, are respected.

VII. Severability clause

Should a provision of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
